LEGAL representatives for Ian Bailey are seeking costs “at the highest level” from the State that could run into millions of euro following Mr Bailey’s successful challenge against extradition proceedings in the Supreme Court.
The legal costs claim includes items not usually claimed for such as the cost of French legal advice.
The Schull resident is wanted for questioning by French authorities who are carrying out a new investigation into the murder of Sophie Toscan du Plantier in Toormore in 1996.
THE Minister for Justice, Alan Shatter, has issued a statement refuting claims published in the Sunday Business Post under the headline “Government tried to conceal key parts of Bailey case investigation”.
According to the minister the allegation is “completely misleading”.
Minister Shatter said that documents which emerged from the DPP about the case were brought to the attention of the Attorney General and arrangements were made to inform solicitors on all sides before the Supreme Court proceedings. [Read more...]
THE Supreme Court in Dublin has upheld Ian Bailey’s appeal against his extradition to France.
The five judges of the court made the decision unanimously.
Mr Bailey is wanted for questioning by the French authorities who have initiated a new investigation into the 1996 murder of French woman Sophie Toscan du Plantier at Toormore, near Schull.
Mr Bailey who lives near Schull was questioned twice in relation to the killing during the original investigation but never charged.

THE Supreme Court in Dublin will today begin hearing the appeal from Ian Bailey against his extradition to France which was ordered by the High Court.
Mr Bailey is wanted for questioning by French authorities as part of a new investigation into the death of Sophie Toscan du Plantier near her holiday home near Toormore, Schull in 1996.
He was questioned twice as part of the original garda investigation but has always denied any involvement in the killing.
NEW evidence presented on behalf of Ian Bailey will be heard as part of his appeal against extradition to France in the Supreme Court that begins on Monday.
The five-judge Supreme Court ordered the new evidence be admitted at a hearing in Dublin today.
Mr Bailey’s legal team had asked for the original High Court appeal to be re-heard in light of the new evidence.
Lawyers for the State had argued that the new evidence, which includes allegations of garda bias in the handling of the case, added nothing new to the case.

IAN Bailey’s appeal to the Supreme Court against his extradition to France to face questions relating to the death of Sophie Toscan du Plantier in 1996 has been adjourned.
The appeal was due to be heard on Monday next but Chief Justice, Ms Justice Susan Denham agreed to a request from Mr Bailey’s legal team to adjourn the appeal this morning.
Mr Bailey’s lawyers said that new evidence they describe as “highly relevant” regarding alleged wrongdoing by state officials at a “breathtaking” level has been provided to them by the Department of Justice and the DPP.
